These are the terms for Webdeck’s website service. Webdeck is run by Joe [SURNAME] (“we” or “us”), [STREET ADDRESS], [TOWN], Gloucestershire, [POSTCODE], UK. By asking us to build your website and going ahead, you agree to these terms. If anything here is unclear, email us at hello@webdeck.co and we’ll happily explain.
Our websites are for businesses. Nothing in these terms affects any rights you have by law.
The two options
One-off build (£195): we design and build your website in your own Wix, Squarespace or WordPress account. The account and the site are yours. You pay the platform directly for its plan, which is what keeps your site online. Its prices are set by the platform and vary between them.
Webdeck plan (£25 a month, or £180 a year): we design and build your website and host it for you, with a domain name, security, backups, upkeep and email support included.
How it works
You tell us about your business and we design your site. You can ask for as many revisions as you like until you’re happy with the design, at no extra cost. Revisions are changes to the site we’ve agreed to build. If you’d like something substantially different, such as extra pages or features we didn’t agree, we’ll tell you first and agree any price with you before doing it. Once you’re happy, we put your site live.
If you decide not to go ahead before your site goes live, you don’t owe us anything. We won’t put the design live, and we’ll remove anything we built in your account.
Paying
There’s nothing to pay until you’re happy with the design and your site is live. Prices are in pounds. We’re not registered for VAT, so no VAT is added.
One-off build: once your site is live we’ll send you a payment link for £195, due within 7 days. If it isn’t paid within 14 days of your site going live, we may unpublish the site until it is.
Webdeck plan: billing starts on the day your site goes live and repeats automatically every month (£25) or every year (£180) until you cancel. Payments are taken by Stripe. If a payment fails and isn’t sorted out within 14 days, we may take your site offline until it is. If we ever change the price, we’ll email you at least 30 days before it applies, so you can cancel first if you wish.
After your site is live
One-off build: the site is yours to run and edit. Changes after it goes live aren’t included, but we’re happy to help: ask and we’ll quote. Your platform’s plan and any updates it needs are yours to look after.
Webdeck plan: hosting, your domain name, security, backups, upkeep and email support are included. Changes to your site’s content, such as new prices, photos, opening hours or pages, aren’t included: ask and we’ll quote.
Your content
Your content is yours. The text, photos, logos and anything else you give us stay your property, and you can use them wherever else you like. By giving them to us, you confirm you have the right to use them and that they’re accurate and lawful. You’re responsible for what your site says about your business, such as prices and claims.
Unless you ask us not to, we may show your website as an example of our work.
Who owns the website
One-off build: once you’ve paid, the website is yours, in your own account, and we remove our access to it.
Webdeck plan: the design and the code behind your site stay with us. They’re part of the service we run for you rather than something you buy outright, so they don’t transfer to you if you leave.
On the Webdeck plan we register your domain name on your behalf, and it’s yours for the asking. Tell us at any point, while you’re with us or after you’ve cancelled, and we’ll transfer it to you free of charge. If you came to us with a domain you already owned, it stays yours throughout and we simply point it at your site.
Cancelling the Webdeck plan
You can cancel anytime from “Manage billing” at the bottom of our website, or by emailing us. Your site stays live until the end of the month or year you’ve already paid for and isn’t renewed after that. We don’t give refunds for the rest of a month or year you’ve already paid for. Once that period ends, your site goes offline, and we’ll transfer your domain name to you free of charge whenever you ask.
We can end the service by giving you at least 30 days’ notice by email, and we’ll refund anything you’ve paid for time after it ends. We can end it straight away if payments aren’t made or your site is used for anything unlawful.
Other services
Your site relies on services run by other companies: Wix, Squarespace or WordPress for the one-off build, and our hosting provider, domain registrar and Stripe. They have their own terms, and we can’t control their prices, features or outages.
Availability
We’ll do our best to keep your website online and running smoothly. We can’t promise it will never be briefly unavailable, as occasional downtime can happen with any website, but we’ll deal with any problems as quickly as we reasonably can.
Our responsibility
We’ll do the work with reasonable care and skill. We’re not responsible for indirect losses, such as lost profits, sales or business opportunities. Our total responsibility to you is limited to the amount you’ve paid us in the 12 months before the problem arose. None of this limits responsibility for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow us to limit.
Changes and the law
We may update these terms from time to time. If a change affects you as a customer, we’ll email you about it first. These terms are governed by the law of England and Wales, and any dispute will be dealt with by the courts of England and Wales.
